LHC Upholds Widow’s Right to Employment After Remarriage

Lahore: The Lahore High Court (LHC) has ruled that a widow of a civil servant cannot lose her job due to remarriage.

The court issued a written decision following the appeal of Zoya Islam, clarifying that her dismissal from government service after her second marriage was unjustified.

A two-member bench, led by Justice Chaudhry Muhammad Iqbal, emphasized that a widow has the fundamental right to remarry according to religious principles, and firing her for this reason violates Sharia law.

The court stated that the previous decision to terminate her employment was based on a misinterpretation of legal precedent.

In her appeal, Zoya Islam explained that she had been appointed as a Naib Qasid in 2020 after the death of her husband, a civil servant.

She argued that her second marriage in 2021 should not have been grounds for dismissal. The court approved her appeal, reinforcing the right of widows to remarry without jeopardizing their employment.
