Peshawar: A recent attempt by the federal government, under the guise of judicial reforms, has been met with widespread concern, with critics alleging that it aims to undermine the judiciary’s independence.
In a press release issued by National Think, a non-governmental organization advocating for transparency and judicial independence, the reforms have been labeled as a deliberate move to erode the judiciary’s autonomy.
“At this critical juncture, the independence of the judiciary—a cardinal principle of the Constitution of the Islamic Republic of Pakistan—is at risk,” the statement reads. The organization warns that this development poses a significant challenge to democratic forces in the country.
The role of bar councils, bar associations, and civil society has become increasingly crucial in this scenario. National Think has raised the question: “Will these groups rise to the challenge and oppose all moves to circumvent the judiciary?”
This is a defining moment for bar councils, bar associations, and civil society organizations, which have long championed democratic values. The enforcement of fundamental rights, which cannot be achieved without an independent judiciary, is also at stake.
Critics argue that granting discretionary powers to the Prime Minister would not only compromise the judiciary’s independence but also damage the spirit of the much-lauded Charter of Democracy, particularly the 18th Amendment.
“It is high time for all democratic forces to come together and protect the independence of the judiciary,” the statement concludes, calling for urgent and collective action to safeguard this cornerstone of democracy in Pakistan.
